Please read the following privacy policy to assist you in understanding how the Candidate Cloud Inc. ("Candidate Cloud") website (the “Website”) handles the collection, use and disclosure of your personal information (the “Privacy Policy”). This Privacy Policy is guided by the provincial and federal privacy laws applicable in British Columbia, Canada.

This Privacy Policy is not exhaustive and Candidate Cloud reserves the right to modify this Privacy Policy at any time, effective upon posting of the modified Privacy Policy to the Website at: http://www.candidatecloud.com/PrivacyPolicy. Changes to this Privacy Policy are deemed to be communicated upon their posting on this website. Your continued use of the Website constitutes your understanding and acceptance of any such changes to the Privacy Policy.


What is Considered Personal Information

Personal information includes recorded information about an identifiable individual, such as name, address, phone number, email address and credit card information (the “Personal Information”). Business contact information is not considered “personal” information.


What Information We Collect

In order to use a form on the Website, a user may be asked to first complete a registration and/or submission form. During registration/login, a user is required to provide contact information (such as a name and email address). This information is used only to contact the user about the services on the Website for which he/she has expressed an interest. It is optional for the user to provide demographic information, but encouraged so we can provide a more personalized customer service and experience on our Website.

Candidate Cloud may also collect certain Personal Information from visitors to and customers of Candidate Cloud's Website, which may include name, address, phone number, Internet address, user IDs and passwords, billing and transaction information, credit card or other financial information and contact preferences. This information is logged to help diagnose technical problems, and to administer Candidate Cloud's Website and Services in order to constantly improve the quality of the Services. Candidate Cloud may also track and analyze non-identifying and aggregate usage and volume statistical information from its visitors and Customers and provide such information to third parties.

In some cases, Candidate Cloud may ask for additional information, in order to provide technical support. Any such additional information would be of a technical nature and remain confidential. Candidate Cloud may access Data stored by a Customer with Candidate Cloud through use of the Services (the “Customer Data”) and other information for technical processing purposes including: (a) the functionality of the Services; (b) the technical requirements of Candidate Cloud's Systems; (c) the technical requirements of the Services; or (d) to conform to other, similar technical requirements. Candidate Cloud may access the Customer's Account and Customer Data as necessary to identify or resolve technical problems or respond to complaints about the Services.

In addition, when you visit the Website, the web server collects a small amount of information to facilitate the operation and security of the Website. This information may include browser type, Internet domain name and IP address. Some information, such as your Internet domain name or IP address, may identify you and be consider Personal Information.

Email Communication

Candidate Cloud will not ask you for personal information via email except in response to an email you have sent to us. If you receive an unsolicited email from Candidate Cloud asking for personal information, please contact our Privacy Department using the form here: http://www.candidatecloud.com/ContactUs. Please also note that when you send us electronic mail, we collect your email address, your internet IP address and your message so that we may reply to you. We recommend that sensitive personal information not be sent unencrypted over the Internet or by e-mail.

With the exception of transactional emails (e.g. confirmation of online registration, account and bill notifications, emails directly related to your business account), we will not send you any email unless you opt-in to receive communications from Candidate Cloud. If you opt-in, you will receive information we believe will be of interest to you. If you decide that you are no longer interested in receiving email from Candidate Cloud, simply unsubscribe by clicking the unsubscribe link in every email and following the simple instructions.

In some cases Candidate Cloud sends outbound emails and although we limit the personal information used, some personal information may be sent. Emails may be sent and stored outside of Canada depending on the email service provider chosen by the customer and used by Candidate Cloud.


Disclosure

Candidate Cloud maintains information about its Customers, including without limitation, User Account information, billing information, Services and support information, and frequency and use of Services. Candidate Cloud may use this data for internal business purposes, or disclose Customer Data in aggregate form (i.e., not individually attributable to Customer) for marketing or other promotional purposes.

Candidate Cloud may also share your Personal Information with third parties in responding to your requests for products or services or product evaluations. Candidate Cloud will not sell, rent, trade or otherwise disclose individual Customer information to any third parties or outside companies for any reasons other than those specified below.

Candidate Cloud may disclose Customer Data if Candidate Cloud believes that such action is reasonably necessary: (a) to comply with the law; (b) to comply with legal process; (c) to enforce its agreements; (d) to respond to claims that the Customer uses the Services to support activities that violate the law or the rights of third parties; or (e) to exculpate Candidate Cloud from charges of wrongdoing. However, Candidate Cloud does not have a duty to make any such disclosures.

Neither Candidate Cloud nor any party it contracts with will disclose Personal Information, Customer Data or Confidential Information to any other person unless such disclosure is required or authorized by law, or with prior written consent of the other party. In the event that a party is legally compelled, through whatever means, to provide access to Personal Information, Customer Data or Confidential Information, then the disclosing party will provide the other party with Notification of such an event as soon as it is reasonably practical to do so as to afford the opportunity to limit or prevent such disclosure. Notwithstanding the foregoing, should a user or Customer violate or cause or encourage a violation of the Terms of Service found at: http://www.candidatecloud.com/TermsOfService, Candidate Cloud will actively assist and cooperate with law enforcement agencies and government authorities in collecting and tendering Personal Information and Confidential Information about the user, Customer and the Customer's Data, as applicable.

Where the Customer provides Candidate Cloud with credit card information, the Customer may be assured that Candidate Cloud endeavors to use secure technologies to protect such information against unauthorized disclosures. Credit card information may be shared with the credit card companies themselves and with other credit verification organizations. Candidate Cloud also may make general information about the purchases available to third parties from time to time.


Use of Information

The use of your email address by Candidate Cloud is necessary to keep you well informed of maintenance, support and usage issues, invoicing and accounting issues, escalated critical issues and problem resolutions that may arise with the Services. Candidate Cloud may also use email addresses to provide its Users with informative newsletters and other information.

Candidate Cloud likes to keep its Customers informed via email and other means. Sometimes Candidate Cloud uses personal and demographic information to help it determine which Services are most likely to be of interest to the Customer or help diagnose problems with its Systems or administration of its websites. Candidate Cloud also uses demographic information to gather general interest in its products, to help in the analysis of product usage, purchasing, and target markets.


Consent

Candidate Cloud does not require that you provide us with personal information. It is a voluntary decision to provide personal information; however, if you do not wish to provide the personal information requested, we may not be able to service you properly or receive the benefit for which the personal information is being requested. Except as expressly stated otherwise in this Privacy Policy, you may opt out of having Candidate Cloud share personal information with third parties as described in this Privacy Policy by notifying Candidate Cloud in writing of your desire to do so.

We will obtain your consent prior to the collection, use or disclosure of your information. Consent may be express or implied. Implied consent means that you provide the information to us and the purpose of providing such information would be clear to you, even if we did not state it.

The Internet is not an absolutely secure medium of communication and Candidate Cloud cannot guarantee the security and privacy of the Personal Information and Customer Data sent over the Internet or stored on its Systems. The Company will use commercially reasonable efforts consistent with the standards of practice in the industry to prevent unauthorized access to and disclosure of the Personal Information and Customer Data exercising the same degree of care that a reasonable and careful Person would exercise with similar data.

Candidate Cloud is committed to continually improving the experience you as you visit our Website. Accordingly, some information gathered on Candidate Cloud's Website is stored in the form of 'cookies'. Cookies are the most effective way to identify a unique visitor and understand their navigation during a visit. Candidate Cloud uses cookies to store your identifications, personalize its site and offer secure Services for each user.

Candidate Cloud's Website contains hypertext links to other websites as a convenience to users.
